Terms of Service

These Terms of Service (“Terms”) govern your use of outtoeat.com.au (the “Site”), operated by Matthews Catering (ABN 89 926 139 698), trading as outtoeat (“we”, “us”, “our”).
By accessing, registering for, or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
If you are under the age of 18 years, you represent that you have obtained the consent of a parent or guardian to use the Site.
1. What outtoeat is
outtoeat is a dining discovery platform that helps you find cafés, restaurants, pubs, and takeaway venues, primarily using live data from the Google Places API, along with information submitted directly by subscribing restaurants.
Where a restaurant has enabled bookings through the Site, outtoeat also facilitates table reservation requests between you and that restaurant.
2. Not a party to your booking
When you book a table through outtoeat, the booking contract is between you and the restaurant — not with outtoeat. We facilitate the connection but are not responsible for:
- The restaurant honouring, delaying, or cancelling your booking
- The quality of food, service, or experience at the venue
- Any dispute arising between you and the restaurant
We recommend contacting the restaurant directly for any booking changes, cancellations, or special requests.
3. Accuracy of information
Restaurant details displayed on the Site — including hours, ratings, pricing, and availability — are sourced from Google Places or self-reported by restaurants, and may not always be accurate or up to date.
In particular:
- Cost-per-head figures are estimates only, derived from category and general price level, not actual menu prices. Always confirm pricing directly with the venue before your visit.
- The “Award Winning” label is an approximate keyword-based search, not a verified list from any official awards body (such as the Good Food Guide or Chef's Hat Awards). Please verify a restaurant's award status independently.
- Opening hours, availability, and contact details should be confirmed with the venue, particularly around public holidays.
4. Acceptable use
When using the Site, you agree not to:
- Submit false, misleading, or fraudulent booking requests
- Attempt to interfere with, disrupt, or overload the Site or its underlying services
- Scrape, copy, or republish Site data at scale without our permission
- Use the Site for any unlawful purpose
- Infringe any person's intellectual property rights
- Upload malicious code, viruses or harmful content
- Reverse engineer or create derivative works from the Site
- Circumvent any technical or security measures
- Use the Site in a manner that could damage our reputation or business
We reserve the right to restrict or terminate access for anyone who breaches these Terms.
5. Intellectual property
The outtoeat name, logo, and original Site content are owned by Matthews Catering. Restaurant data displayed via the Google Places API remains subject to Google's own terms and ownership.
You must not use our intellectual property except as expressly permitted under these Terms.
No ownership rights are transferred to you.
All rights not expressly granted are reserved by us.
6. Limitation of liability
To the maximum extent permitted by law, outtoeat is not liable for any indirect, incidental, or consequential loss arising from your use of the Site, including but not limited to loss arising from inaccurate restaurant information, booking issues, or Site downtime.
Nothing in these Terms excludes any consumer guarantee or right under the Australian Consumer Law that cannot be lawfully excluded.
Where liability cannot be excluded but may be limited, our liability is limited, at our option, to:
- supplying the Site again; or
- payment of the cost of having the Site supplied again.
7. Third-party links
The Site contains links to third-party restaurant websites, Google Maps, and social media pages (collectively, “Third-Party Sites”). We do not control and are not responsible for the content, accuracy, or practices of these Third-Party Sites.
Your use of Third-Party Sites is governed by the applicable third-party terms and policies.
8. Privacy
Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.
By using the Site, you acknowledge that your personal information may be collected and processed in accordance with the Privacy Policy.
9. Disclaimers
To the maximum extent permitted by law:
- the Site is provided “as is” and “as available” basis;
- we do not warrant that the Site will be uninterrupted, secure or error-free;
- we do not guarantee the accuracy, completeness or reliability of content available through the Site; and
- information provided through the Site is for general informational purposes only and is not professional advice.
You are responsible for determining whether the Site is suitable for your needs.
10. Security
Although we implement reasonable security measures, no system is completely secure.
You acknowledge the inherent risk associated with internet-based services and electronic communications.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
